Yeti delivery is a website operated by YetiDelivery Limited

(a private company whose owners are legally responsible for its debts only to the extent of the amount of capital they invested.)

Yeti Delivery is a business where food is made and prepared by independent restaurants and delivered by us.

Purpose:

The purpose of our Service is to provide a simple and convenient service to you, linking you to the Partner Restaurant and menu of their choice and allowing you to order Meals from them. YetiDelivery markets Meals on behalf of our Partner Restaurants, concludes orders on their behalf and delivers the Meals to you.

Orders

Yeti Delivery offers an ordering and delivery service from our partnering restaurants throughout the Torbay area where each restaurant has a corresponding delivery radius. This is to ensure that the meals reach your door in their best condition whilst enabling as many customers to be a part of a maximum delivery radius. Delivery for participating restaurants will not be available to customers outside of the delivery radius. We do not accept orders to individuals outside the radius. Operating hours of different partnering restaurants vary and are not shown on our website, please visit participating restaurants operating times elsewhere. For the safety of our drivers, a driver will only deliver to the main door/reception when delivering to apartment blocks, flats or hotels.

Meals

All meals are subject to availability, your partnering restaurant may offer an alternative if the selected option cannot be provided. Our partnering restaurants may use nuts and other allergens in the preparation of their meals. Please contact our partnering restaurants prior to ordering if you have an allergy or dietary requirement. YetiDelivery cannot guarantee that any of our meals sold by our partnering restaurants or delivered by us are free of allergens. 

Availability/cancellation

our aim is to provide the best delivery service as possible and our drivers strive to deliver your meals within a reasonable time if the time has been set for ASAP however some external factors which are beyond our control may hinder this time such as road conditions, weather and the volume of orders. Considering these factors Yeti Delivery reserves discretionary right to accept refunds from customers within a reasonable time before food preparation has started. In the unfortunate event that a restaurant must cancel your order after it has been accepted the restaurant will notify you. We and our participating restaurants have the right to cancel any order, before or after acceptance and will notify you immediately of such cancellation. You will not be charged for a cancellation of your meal and we will reimburse any payments made the same method originally used by you to pay for your meal.

 

SALE OF ALCOHOL

Persons placing an order for alcohol from our Partner Restaurants must be aged 18 or over. Alcoholic beverages can only be sold and delivered to persons aged 18 or over. Yeti Delivery operates the Challenge 25 age verification policy whereby customers who look under 25 will be asked to provide proof of age to show that they are aged 18 or over. By placing an order that includes alcohol, you confirm that you are at least 18 years old. Yeti Delivery reserves the right to refuse to deliver any alcohol to any person who does not appear, or cannot prove they are, aged 18 or over. Yeti Delivery also reserves the right to refuse to deliver any alcohol to any person who is, or appears to be, under the influence of either alcohol or drugs.

 

Waiver

If we fail to insist that you perform any of your obligations under these terms and conditions, or if we do not enforce our rights against you, or delay in doing so, that will not mean that we have waived our rights against you or that you do not have to comply with those obligations. If we waive a default by you, this will only be done in writing, and will not mean that we will automatically waive any later default by you.

Price and payment
Prices are as shown from the menus with slightly increased prices from non-independent restaurants. A minimum spend of £12 is required to be eligible for delivery, changes will not affect orders already placed unless due to technical error prices include VAT. Prices are set by each restaurant and will vary between stores. Each restaurant will typically verify prices as part of the order process and its decision in relation to pricing is final and binding.

Events outside of our control

We and our Franchisees will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a contract that is caused by events outside our reasonable control (a "Force Majeure Event").

A Force Majeure Event includes any act, event, non-happening, omission or accident beyond both our reasonable control and the reasonable control of our Franchisees and includes in particular (without limitation) the following:

  1. strikes, lock-outs or other industrial action;
  2. civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war;
  3. fire, explosion, storm, flood, extreme snow, ice, earthquake, subsidence, epidemic or other natural disaster;
  4. impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport;
  5. impossibility of the use of public or private telecommunications networks;
  6. the acts, decrees, legislation, regulations or restrictions of any government; or
  7. non-performance by suppliers or subcontractors.

Our Liability

If we and/or a restaurant fail to comply with these terms, we and/or the restaurant (as applicable) are responsible for loss or damage you suffer that is a foreseeable result of the breach of these terms or negligence, up to the amount of the purchase price you paid for the order applicable to your claim.

However, we and/or the restaurant (as applicable) are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it is an obvious consequence of a breach or if it would reasonably be contemplated by you, us and the restaurant at the time of your purchase.

 

Severability

Each of the paragraphs of these terms and conditions operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.

 

Using our Website

Access to our Site and to our Service is permitted on a temporary basis, and we reserve the right to withdraw or amend access to our Site or our Service without notice. We will not be liable if, for any reason, our Site or our Service is unavailable at any time or for any period. From time to time, we may restrict access to some parts our Site or our Service, or our entire Site or Service to users who have registered with us. You are responsible for maintaining the confidentially of your login details and any activities that occur under your account. If you have chosen to remain anonymous through settings on your device then this information will be obtained and collected automatically if you agree to use these services on your electronic devices. Through any application, (Facebook app or website or any other means).

Once you have placed an order you agree to be bound by the terms listed in this privacy policy.

It will also enable us to bill you and to contact you where necessary in relation to our services. In addition, we may need to provide your data to any of our "Partnering Restaurants" that you have placed your order with this will be done with accordance to relevant statutes. By submitting your personal data, you agree to this transfer, storing and or processing. Yeti Delivery will take every reasonable steps to ensure that your data is treated and stored securely to coincide with this privacy policy.

If you have used our website and consented we may allow carefully selected third parties, including marketing and advertising companies, including any of our affiliates and associates, to contact you occasionally about services that may be of interest to you for example special offers or vouchers. They may contact you by telephone, SMS as well as by e-mail. If you change your mind about being contacted by these companies in the future, please amend your preferences accordingly, or refrain from using our applications.

We may use the information that you provide to us if we are under a duty to disclose or share your information in order to comply with (and/or where we believe we are under a duty to comply with) any legal obligation; or in order to enforce our Website Terms and any other agreement; or to protect the rights of Yeti Delivery, Partner Restaurants or others.
